Paradox never agreed to a Terms of Service with GSPoetry.com
During his registration he agreed to Terms of Service with GhettoSoul.com
Paradox’s Registration took effect December 19, 2007
GSPoetry.com was introduced March 05, 2007
While the Terms & Conditions of an agreement may be changed, altered or substituted, the parties involved may not be substituted without a new agreement being acknowledged by the all parties involved.
When the name took place there should have been a new agreement distributed to all the members.

But there is much more to this issue……
As it has been mentioned before, this isn’t the first time that this type of conflict has taken place…..

(11:06 PM) I see that someone is soliciting people to come aboard his plans of making PP global.
I can't be blind to the fact of what is going on here. He's promoting other sites and soliciting other members to join him. I really don't have any problem with that. It's a free internet. A free choice. It's his profile. Though he is violating the Terms and Conditions of GS, I won't "hate" on his ambitions and his goals by disabling or deleting his "ACCOUNTS". Instead, I encourage people to do as he is doing, and that is making a choice. You can choose to stay on GS or you can choose to leave and follow him.
A few members have contacted me today and expressed their displeasure and anger for what he is doing. In all honesty, it is foul. We've spoken many times and I always thought he had GS's best interest in mind. It's become obvious he doesn't. That's why I feel betrayed. I will not discuss any of our past discussions about GS or about him personally. The only thing I will say is that if any member does decide to follow his lead, keep you eyes wide open. GS will always be here if you want to come back.
And to this member who is soliciting others to leave, (LP, H2O or Paradox, whomever), all the best in your plans.

At this point where AC publicly announced & acknowledged as the owner of the site the fact that he was not going to follow through on the Terms and Conditions of GS, the Terms & Conditions had then became void because nowhere in the policy does it state or give you the authorization to randomly decide when to & when not to enforce the Terms & Conditions, nor is it lawful for you to do so because that would fall under what is considered to be discrimination, an unlawful offense, so there after, any supposed violations of the Terms & Conditions was of no

(11:28 AM) I have no problems for people wanting to grow. No problem at all. I want you guys to expand and try new things. Isn't that what life's about? Growing, maturing and moving on? Of course! As I said to LP, I had no problem with what he did, just how he did it.
There are members that I'm tight with. They have told me they visited other poetry sites and are members of those sites. No problem. They even referred other members to those sites. No problem. But they didn't put it on blast on the site for all to see
I know LP was promoting RESOURCES and not asking people to join other poetry websites or to leave GS. Regardless of his good intentions, my feelings were genuine and I had the right to feel the way I felt. Real talk, I've had GS for 7 years, why wouldn't something like that bother me the way it did? Feel me?
To put this to bed, many blessings to all the members of the group. And I mean that whole-heartedly. Please grow. Please improve. Please do what's best for you. GS was built for one purpose: express and vent your emotions through poetry without censorship. That's what it will always be for and it will always be here for you.

Now while I do acknowledge that many of the terms used in your posting were very vague as far as detail of what you meant by…..

For this can be taken a multitude of ways depending on the ways in which one choses to perceive. The one statement which is undisputable as far as meaning is …..

“GS was built for one purpose: express and vent your emotions through poetry without censorship. That's what it will always be for and it will always be here for you.”

And if you look at Poetic Prodigies intended purpose…..it falls nowhere within those guidelines to be considered “competition”, for Poetic Prodigies purpose is to network with poets, writers, poetry sites & writing sites. GSPoetry is considered a “poetry site” so if anything Poetic Prodigies would fall as a potential networking partner or affiliate, not as a competitive site.

In case you haven’t had the time to go look at the purpose which has been posted on the front page of the site since day one of the site has come into existence….here it is….

The Terms & Conditions thus stated during the time of the disablement of the profile…

“4.6 - If any member attempts to use GS Poetry to promote or benefit, financially or non-financially, the member's own website without the permission of the GS Poetry Founder will have their profile disabled or deleted. GS Poetry.com takes NO RESPONSIBILTY for any member that creates their own website and solicits GS Poetry members to join that website without the prior approval of the GS Poetry Founder. GS Poetry will not be held liable for any content, broadcasts, legal violations, libel, defamation or any other actions of that member's personal website.”

www.poeticprodigies.com is owned by a legal entity, a not-for-profit organization which operates under the trade name My House Your House Multiservice Center. My House Your House Multiservice Center is not a member of GSPoetry, there fore there was no violation of this clause.


We have no other choice but to handle it in the system of
justice.



Why?



• Invasion
of paradox’s privacy by exhibiting the situation to the entire website of
over 10 thousand members through a Mass PM regarding a matter in which did
not even occur on GSPoetry.com. And sending Mass PM’s to over ten thousand
people with links to two blog entries about Paradox [entitled “change”…
and later on that day… “Radio show”] which belittled and demeaned him as a
member on Gspoetry.com, but as a person.



• Disabling
his profile for a matter that was in no way, shape, or form in violation
of the terms and conditions of the website…



(Nowhere in the terms and
conditions does it say “no member of GS is permitted to think about prank
calling the owner of the site or any member of GS poetry” [AC said on the radio
show “….The thought should not even have crossed your mind”…] even if he had he
actually done it, he still would not have been in violation of any terms or condition
of the site and also Paradox’s radio show is not a part of GS…Members of GS
call into the show true enough but members of GS are also members of myspace,
yahoo, hiphoppoetry.com so on and so forth…you do not own the members of the
site nor do you control what they do off of the site.)

• Fraudulence
in disabling Paradox’s account...AC stated on the radio show that he took
it personally, and prior to that he wrote in his blog that this is the
reason for disabling his profile…which is clearly personal and has nothing
to do with GS poetry.com

• Putting
Paradox on display for the whole website about something he did not even
do, something he did not do on GS poetry.com was a deliberate
misrepresentation, and distortion and defamation of Paradox’s character.
AC deletes accounts all the time we don’t receive a pm about it…blogs
aren’t made about it…and it is not advertised on the front page…so this is
an act of discrimination

• Slander...verbal
statements made by AC on the radio pertaining to Paradox concerning his intentions
on Gspoetry.com and his intentions on www.poeticprodigies.com
• Libel…the
blog entries entitled “change” and “radio show” which entail derogatory
written statements pertaining to Paradox "he is not a real man" Statements
made to belittle and demean his character.
Ac deleted Miss Toya’s blog comment in support of Parodox...but left up the other
comments that helped contribute to the defamation of Paradox’s character...It
is plain and blatant discrimination...and it can and will stand in court.



MissToya works for a lawyer….
Paradox wasn't going to take it there but it may be the
only way to prove that this is an injustice. Every piece of documentation including
but not limited to PM conversations, group threads, and blog entries are saved
and printed in case you decide to delete them…the radio show has been recorded also...
• So to
summarize this post….it is plain and blatant DISCRIMINATION to disable his
profile because he had a THOUGHT, you took it PERSONAL, and you stated numerous places that THIS
WAS THE REASON WHY….so right there HE VIOLATED NO TERMS.....And the radio
show is not a part of GS poetry…you can not control what anyone does off
of www.gspoetry.com It is SLANDER to Put him on “blast” by
posting blogs about him and sending mass pm's to over ten thousand people
to humiliate him...It’s LIBEL to write it… it’s INVASION OF PARADOX’S
PRIVACY to exhibit the situation to
the entire website of over 10 thousand members through a Mass PM REGARDING
A MATTER IN WHICH DID NOT EVEN OCCUR ON GSPOETRY.COM. and you disabled his
account for something he did not do...because he THOUGHT about it…and
furthermore, he didn’t think about
it on GSpoetry.com
